Wrongful Death
A wrongful death claim is a lawsuit alleging that the decedent was killed as a result of negligence (or fault) on the part of one or more defendants. The surviving dependents or beneficiaries may be entitled to monetary damages as a result of the defendant’s negligent conduct.
The following damages, if applicable, may be recovered in a wrongful death lawsuit:
1. Immediate medical and funeral expenses associated with the death;
2. Loss of victim’s anticipated future earnings until time of retirement or death;
3. Loss of benefits caused by the victim’s death, such as pension and medical coverage;
4. Loss of care, protection, and companionship sustained by the decedent’s spouse;
5. Compensation for the pain and suffering of the decedent;
6. In those cases where circumstances show it is merited, punitive damages may be recovered.
